A New Low In Indian Politics

Late last week, a special CBI court adjourned the bail application of Amit Shah in the Sohrabuddin and Tulsi Prajapati fake encounter cases, accepting his excuse that he was engaged in political work in New Delhi. Shah, 49, the first serving Home minister of a state to have gone behind bars in a criminal case of murder and conspiracy had a legitimate reason to skip court hearings. He was presiding and taking part in day-long meetings in Delhi with senior RSS leaders and BJP functionaries who were all set to seal his fate as the next BJP President.

There is a significant back story to his exemption which did find its way as a small snippet in the media but needs to be brought to light as Shah, the man who waved the magic wand for BJP in Uttar Pradesh, the PM’s confidante and the number two in the government now takes over the reins of the party. Amit Shah had twice in the past sought exemption from personal appearance citing political work, but the then CBI judge JT Utpat had found his excuse inadequate for the court to grant him relief. On June 20, while hearing the application, Utpat allowed the same but made a scathing remark “Everytime you are giving this exemption application without assigning any reason,” he told Shahs counsel. In less than a week, Utpat was transferred to a Pune court before he could preside over Shahs discharge application. Shah managed his way out with a tried and tested formula of transferring judges, practiced brazenly in his home state of Gujarat through his tenure as Home Minister.

As a journalist covering Gujarat extensively since 2005, as someone who exposed Shah’s role in the fake encounters in the state and who can claim to have knowledge of his political trajectory, I would not mince my words in suggesting that by appointing Amit Shah as the president of the party, the BJP has hugely disrespected the law of the land and signalled an all time low for the criminal justice system of India. For the cases against Shah are for crimes so gruesome that the cloak of political astuteness will be too short to cover it.

In its chargesheet filed in the Sohrabuddin fake encounter case, the CBI which had been investigating the case under the watchful eye of the Supreme Court of India had not just named Shah as one of the key accused and conspirators but also named him as the head of an extortion racket which involved underworld thugs, politicians and businessmen. In its submission before the apex court bench of Justice P Sathasivam and Justice BS Chauhan, the CBI stated that the minister was in cahoots with senior cops from Gujarat including the likes of DG Vanzara and Abhay Chudasama who had been sentenced for cold-blooded murder – concluding that Shah was a hardcore criminal. Shah was also chargesheeted in the murder of Kauser Bi, the wife of Sohrabuddin who according to the official papers was raped, sedated, killed and her body burnt and thrown in a river.

One could have well debated the merits of the CBI chargesheet and read political motives but for the fact that the Supreme court itself gave CBI the sanction to arrest Shah at the same time, coming down harshly on the Gujarat state police investigation led by the then top cop Geeta Johri for going slow and misleading the courts. If the SIT verdict on Narendra Modi’s role in the Gujarat encounters is to be held as the final word, by virtue of it being monitored by the apex court, it is baffling then that Narendra Modi who promised clean and transparent governance to this country and setting up fast track courts to look into cases of criminal charges against politicians has turned a blind eye to Shah’s criminal past.

Shah has been Modi’s confidante since his days as a pracharak in Gujarat and Maharashtra. With Shah's kinduction on the national scene first as the General Secretary of the BJP and now as the BJP President, Modi has risked his own political image for the sake of his ally and friend who has put to shame the best political pundits and strategists from North India with his shrewd manoeuvring. In the coming days, the party will have to prove its popularity not just in the by-elections of Uttar Pradesh but also in the forthcoming Assembly Elections in three states, the most significant being the battle for Maharashtra. Party insiders have stressed on Maharashtra being a prestige battle for Modi whose party swept the Lok Sabha elections a couple of months ago. Going by the minutes of the internal meetings held between Modi, Shah and senior heads in the BJP and the RSS, the Prime Minister has silenced his detractors in the party who were against Shah's elevation citing his ability to churn out big numbers.

Many in the Gujarat BJP believe that Modi has been under tremendous pressure by Shah to return the favours he has allegedly bestowed on his mentor in the last two decades of their association. It’s a well known fact that during Modi's rebellion against former Gujarat Chief Minister Keshubhai Patel and in his fight with the ex-Home Minister of Gujarat Haren Pandya, it was Shah who stood firmly by Modi's side galvanizing the cadres and leaders in favour of his boss.

As the second in command in the Modi dispensation, the youngest minister in his cabinet who held charge of twelve ministries including the powerful Minister of State for Home, Shah single-handedly thwarted all trouble that came in the way of Modi with his office getting the infamous tag of the “dirty tricks department of the CM”. It was under his tenure as Home Minister that the Gujarat police went on a spree of fake encounters in the state – holding regular press conferences for the media with the bodies of the alleged assassins on display. The officers would claim that the Gujarat CM was under threat from jihadists who were out to assassinate the man who brought back Hindu asmita in Gujarat.

While the chief minister managed to leave unscathed during the investigations of most of the encounters which were later pronounced as fake, Shah found himself listed as the prime accused in three encounters, his role in the other two being probed by the CBI with investigations in the case still on.

Another major dent in Shah's image came with his alleged involvement in the Snoopgate scandal, in which he is heard instructing one of his key lieutenants – IPS officer GL Singhal who was then incharge of the ATS, to carry on surveillance on a young woman. The tapes which were released late last year created a furore after it became obvious that Shah as the Home Minister of the state was using state machinery to snoop on innocent civilians, monitoring their moves. In this particular case, a young woman whose movements, including aspects of her personal life were being reported to the CM on a daily basis.

With such serious criminal charges against him, has Modi denigrated the position of the party president by khanding over Shah the reins of the party. Would it now be safe to assume that Prime Minister Narendra Modi acted against the interests of the judiciary by rejecting the nomination of Gopal Subramaniam as a Supreme court judge as he was also the amicus curiae in the Sohrabuddin fake encounter case. Ever since the Prime Minister assumed office, ex-CBI directors including Ashwini Kumar and AP Singh who were at the helm of affairs in the CBI during the investigation of the encounters, find themselves being at the receiving end of Shah's wrath. While Kumar has stepped down as governor of Nagaland, AP Singh is reportedly under pressure to step down as member of the UPSC after the Income Tax department served notices to him and his family members in an investigation into alleged tax evasion by meat exporter Moin Qureshi.

These could all well be coincidences if one were to take a larger liberal view of the developments including the transfer of 89-year-old ailing governor of Gujarat Kamla Beniwal, who under her tenure locked horns with Modi and Shah over the appointment of Lokayukta in the state. But even if one were to dismiss these actions against officials, lawyers, judges who played significant roles in the criminal justice process involving Amit Shah as conjectures, will it not be pertinent to suggest that by appointing Shah as the BJP President, Modi has acted in contradiction to his promise of a free and fair government, which will have no space for vindictiveness. Hasn't Modi and the BJP under the guidance of the RSS just made the first attack on the principle of clean governance on the basis of which the party came to power? Prime Minister Narendra Modi needs to answer this one.

  4. Why the educated Muslims are are brainwashed by the Jihad terrorism and turn to violence?

    This question is highlighting all but there is no answer to it.These boys who are the eyes of their parents gets good education and gets good jobs in India’s best companies are getting to terrorist activities and turn to a potential bomb. Why it so and what can be done to check the slow poison?

    In Hyderabad one driver of the best IT Company of the world has been held by police on the suspicions of being a potential bomber. What would he gain by killing innocent Indians and may be some foreigners of that company? Is there any answer among the so called secular media personnel’s and politicians? Many boys from minority Muslims are turning terrorists as if they can create havoc among Indians and take their revenge. What revenge they want to take on innocent Indians? They are digging their own graves. They are slowly being outcastes in all the recruiting agencies who do not want to employ any Muslims as they fear that the person/boy or girl may be a terrorist and may cause harm to its credibility and company.

    Also they lost all the trust with the security agencies of India who do not want to recruit them only with an apprehension that they may betray their trust/faith. So it is the lack of faith and trust for all the Muslims which would lead them to more unemployment and poverty. That apart from all these apprehensions it is also true that after any such incidents police gets track of that accused and goes after him which leads it to that company which employed them. So none of company in India and foreign are going to recruit any Muslims,so be highly educated and uneducated. They would suffer the curse of unemployment by their behavior and antecedents. The Muslims as whole have to accept the fact that due to the misdeeds of s few misguided and disgruntled elements who are brainwashed by the jihad terrorists through internet,CD,DVD and pamphlets with video clips of Gujarat riot.That it is also true that by the acts some Muslims all of them are now feels isolated and being blamed as traitors to the nation. They cannot hold their heads in high. Their credibility is lost by misdeeds and anti national acts of some few Muslim boys and clergyman. It is not a good symptom. It caused alienation of all the Muslims from mainstream politics and people. They cannot hold their heads in high out of shame and fear.But who would teach the all these. Our Media is silent in this aspect and watching degeneration of them and alienation of Muslims in the Indian society. It is true that all people in India are equal and not having any such status of second class citizen’s, albeit all the Hindus in Pakistan are having a status of second class citizens and the temples and gurudwaras of Hindu and Sikhs are demolished and occupied by Muslims .They enjoy as much freedom as any majority clan gets in our country. But the trauma is that they themselves remained in their cocoons and fails to accept the facts.
    It would be better if the Muslims of India gets an awakening and change their attitudes. They can get their credibility and trustworthiness back if they would assimilate themselves with the mainstream and society. They can very well change their own fortunes if they would start to check the boys going to jihad and also hold their heads high.

    APNA GHAR JALAKE TAMASHA DEKHNA BANDH KARO.Hindustan hum sabka hai.This should be ultimate motto of all the muslims.They should not be made scapegoats of crude politicians who are using them as sacrificial goats.

    The unprecedented swelling of support in favour of BJP and Narendra Modi shows that Congress is under highly vulnerable position. The media propaganda will not able to save congress from a severe negative voting in 2014 when election will be held.The opinion poll also showed the popularity of Namo Vrs Rahul.
    Now it is high time that all Muslims should think before they support Congress or any other party next election and instead support BJP as BJP is not anti-Muslim or anti-Christian.

The right to expression legitimizes all such writings and utterances within the framework of civility provided there is law of land to prosecute any unfounded allegation. I dare to say this even if I support Narendra Modi also being an active RSS volunteer.

  19. No editor should allow such a badly written, illogical and blatantly biased article to go to the Press. DNA India may have pulled this for the wrong reason but it remains a bad piece.
    This is not the time to be complacent re. the new regime. Just repeating the old slogans won't do. If you mention Justice Utpat's transfer you should mention the supposed reason behind it- viz. his desire to be with his daughter in Pune- rather than leave a suggestio falsi hanging in the air. Why? Someone reading this will get the idea that Utpat is a potential whistleblower and so concentrate on that angle.
    The anti-Parivar intelligentsia, over the last 10 years got lazy and complacent. They repeated each others lies and horror stories. They didn't care that this sort of behaviour discredited their own cause and made it impossible for the Courts to take action.
    By contrast, Gandhi-at Champaran and later heading up the Investigation into the Jallianwallah Bagh massacre- was scrupulous in striking out blatant lies and even toning down 'sensational' testimony as to genuine atrocities. For this, he won the respect of first Rajendra Prasad and later even the fire-brand Nehru.
    Congress had 10 years to convict Modi and Shah and so on. Since their strategy in Gujarat was to poach the worst Muslim baiters, they weren't really interested in sending anyone to jail.
    It's bad tactics to call Amit Shah 'a hardened criminal'. He isn't. He became a criminal only ex officio, so to speak.
    I write this not to castigate this journalist. She wrote hastily and in the heat of the moment. The job of the editor, like Gandhi at Champaran, is to blue pencil that which affronts our reason by reason of being too impassioned and impressionistic.
    I think she feels betrayed because she never received editorial support in the first place. Perhaps, her status as a female Muslim journalist- in a country where the vast majority of Muslim women simply have no voice (perhaps they constitute the largest such truly 'subaltern' group in the country)- added prestige and credibility to those who published her articles. But they owed her an editorial duty of care.
    We've just had an election where the party which won said that the CBI was a Congress tool. Judges can't ignore this. It is germane to the underlying issue re. bail. The Public trusts Amit Shah. The allegation that he is a 'hardened criminal' now requires proof, not vituperative re-assertion.

  20. Ayyub must up her game. She needs to research things, interview people, bring new facts to light. Careless and hasty writing- which she has republished here in the interest of Truth- was the laissez passer of the UPA-era 'Secular' intelligentsia.
    People took pride in saying 'Why are you boasting that you wrote your anti-Modi piece, where you showed he ate Muslim babies for breakfast while watching Hitler movies, in just 30 seconds? It took me just 15 seconds to write my 1000 word essay for Outlook on how Modi refuses to wear Muslim skull-cap, though Shahi-Imam is weeping and touching his feet to prevail upon himself to do so, while eating Muslim babies and watching Hitler porn.'
    What was the result of such self-righteous refusal to use your brains or edit your own outpourings? Did it lead to anything good? Won't we all now have to go back to Hindi or Gujerati or whatever in order to re-connect with the sort of people who actually vote? Won't we have to explain what Secularism can do to transform the Life-Chances of people who look like us- well, maybe thinner, shorter, more sun-burnt- and who still speak the language- the mother tongue- we came to feel, under UPA, it was beneath us to even understand?

    Clearly an 89 year old ailing Governor should be sacked not transferred. It appears, from this article, that the only reason she wasn't sacked but given a new berth was because 'she had locked horns with Modi'.
    The Journalist and the Barrister aren't so different. Yes, in the short run you can get drunk and achieve success by impassioned, illogical, rhetoric. But, once the judgement is appealed, such tactics are counter-productive.
    That's why the best Barristers- and Gandhi and Motilal and Jinnah and Patel and so on were all Barristers- prepared their case very thoroughly.
    Rana Ayyub, I appeal to you- please shake off the bad habits of the last ten years. You are young. You are full of passion. These are good things. Now acquire Discipline.
    Previously, Secularism was about 'crying wolf'. Now the wolf is at the door. Be economical of rhetoric but prodigal in investigative effort.

  24. There was a report recently where HC was questioning why such huge percentage of deaths in custody are of the criminals belonging to minorities in Maharashtra.
    Now that's the state of Ms. Rana Ayyub, where she resides. But there won't be any word on it from her.
    Probably because secular Congress-NCP rule there.

    Although its perfectly fine for her to blame Modi/Shah/BJP/RSS for wrong-doings.
    But don't try make it look like as if you do it out of your pain you feel for minorities, because its a clear case of journalistic mouthpiece of a political party.
